These Terms of Service ("Terms") govern access to and use of kivide.com and related Kivide services (the "Service"). By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service.
1. The Service
Kivide provides AI-powered tools to generate images and videos from text prompts and optional reference media. Features, models, and availability may change. We may modify, suspend, or discontinue parts of the Service with reasonable notice when practicable.
2. Accounts
You must provide accurate registration information and keep credentials secure. You are responsible for activity under your account. Notify us promptly of unauthorized use. We may suspend or terminate accounts that violate these Terms or pose risk to the Service or other users.
3. Credits, plans, and payments
Generation features consume credits or require an active plan as displayed in the product. Prices, credit costs, and plan benefits are shown at purchase and may change for future purchases. Payments are processed by third-party processors; their terms also apply. Taxes may be added where required. Unused promotional credits may expire as stated at grant.
4. Refunds
If a paid generation fails due to a Service or provider error, credits consumed for that generation are automatically refunded to your balance when our systems detect the failure. Content blocked by safety moderation after generation is also refunded as credits. Except where required by law or expressly stated, paid subscription fees and credit pack purchases are generally non-refundable once payment succeeds. Chargebacks or payment disputes may result in account suspension. For billing help, email support@kivide.com.
5. Acceptable use
You may not use the Service to create, upload, or request illegal content; child sexual exploitation or abuse material; non-consensual intimate imagery; content that facilitates violent crime, terrorism, or severe harm; malware; spam; or infringement of others' IP or privacy rights. You may not reverse engineer the Service, bypass rate limits or safety systems, scrape at scale, or resell access without our written permission. We use automated and manual moderation and may block prompts or outputs that violate policy.
6. Your content and license
You retain rights you already hold in prompts and inputs you provide. Subject to your plan and applicable law, you own the outputs the Service generates for you, except that you grant Kivide a worldwide, non-exclusive license to host, process, moderate, and display content as needed to operate and improve the Service (including safety systems). Free-tier outputs may appear in public showcases unless your plan provides private generation. You represent that you have all rights needed for your inputs and that your use of outputs complies with law and third-party rights.
7. Third-party models and providers
Generation is fulfilled via third-party AI and infrastructure providers. Their availability, quality, and policies can affect results. We are not liable for outages or model behavior outside our reasonable control, beyond credit refunds described above.
8. Intellectual property
The Service, branding, software, and documentation are owned by Kivide or its licensors. These Terms do not transfer our IP to you except for the limited right to use the Service as allowed.
9. Disclaimers
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. AI outputs may be inaccurate, offensive, or unsuitable; you are solely responsible for reviewing and using them.
10. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, KIVIDE AND ITS SUPPLIERS ARE NOT LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR LOST PROFITS, DATA, OR GOODWILL. OUR TOTAL LIABILITY FOR ANY CLAIM RELATED TO THE SERVICE IS LIMITED TO THE AMOUNTS YOU PAID US FOR THE SERVICE IN THE THREE (3) MONTHS BEFORE THE CLAIM.
11. Indemnity
You will defend and indemnify Kivide against claims arising from your content, your use of the Service, or your violation of these Terms or applicable law.
12. Termination
You may stop using the Service at any time. We may suspend or terminate access for violations, risk, or extended inactivity. Provisions that by nature should survive (including IP, disclaimers, liability limits, and indemnity) will survive termination.
13. Changes to Terms
We may update these Terms. Material changes will be indicated by updating the "Last updated" date and, where appropriate, additional notice. Continued use after the effective date constitutes acceptance.
